End the Anders Brief

Proposed Law

Read the proposed national legislation to abolish the Anders brief and encourage all state legislatures to take similar steps for state-level equivalent procedures.

 

This proposed law was drafted by Aaron Spolin, a criminal appeals attorney.  The law seeks to (1) tie compensation to the ability to argue viable issues, (2) guarantee 2nd-level attorney review of claims from a 1st-level attorney that there are no arguable issues, (3) prevent attorneys from publicly informing the court of the alleged mertilessness of their clients’ cases, (4) provide clients with sufficient time to pursue their appeals if no lawyer is willing to assist them, and (5) create a private database tracking the frequency which which attorneys file Anders briefs.
